Tether.me BTC Giveaway

The Tether Wallet Terms of Use available at https://wallet.tether.io/application-terms/ are referred to herein as the "Terms of Use," as they may be changed, amended, modified, or updated from time to time. Capitalized terms used, but not defined in these Rules, have the meanings set out in the Terms of Use.

As a condition of your participation in the Tether.me BTC Giveaway, you must: (a) hold a valid tether.me account; (b) have an account on X (formerly Twitter); (c) be at least the age of majority in your jurisdiction; and (d) you must not be a person or entity that is listed on a sanctions list or subject to a comprehensive embargo by the governments of the United States, El Salvador or the United Nations. Eligible participants must at all times comply with these Rules and the Terms of Use. Void where prohibited or restricted by law.

The Giveaway will begin and end on the dates and times communicated by the @BTC account on X (the "Giveaway Period"). Tether Data, S.A. de C.V. ("Tether Data") will apply daily limits on how much BTC it will make available in the Giveaway.

1. There is no purchase necessary to participate in the Giveaway. You can participate by replying to @BTC with your valid Tether.me address.
2. Limit of one (1) participation in the Giveaway per person and per X account. In the case of multiple attempts to participate, only the first eligible entry will be considered.
3. Your reply must be received no later than the end of the Giveaway Period and before the daily limit is reached. Replies will be invalid if they are late, illegible, received after the daily limit has been reached, or otherwise irregular.
4. Participation will be deemed to be submitted by the authorized account holder of the X account associated with the entry. For the purpose of the Rules, "authorized account holder" of the X account is defined as the natural person who is assigned to the X account by X Corp. X Internet Unlimited Company or one of its Affiliates ("X Group"), as applicable.

1. Prize. There are a limited number of prizes available in the Giveaway, consisting of approximately US$0.10 worth of Bitcoin on the lightning network (each a "Prize"). Approximate retail value of each Prize is USD$0.10.
2. Prize Distribution. Prizes will be distributed to eligible participants within 10 days after the end of the Giveaway Period. Winners will receive their Prize at the lightning address associated with their Tether.me address. Tether Data is relying on a third party network for Prize delivery and is not responsible for errors, delays or non-receipt of a Prize caused by third party networks.
3. Limitations. The Prize must be accepted as awarded and cannot be assigned, substituted or redeemed for cash. Tether Data at all times reserves the right to substitute any Prize with a prize or property of equal or greater value, determined in Tether Data's sole and absolute discretion.
4. Tether.me Address Accuracy. You are solely responsible for providing an accurate and valid Tether.me address. Tether Data assumes no responsibility for rewards lost due to incorrect address information.
5. Risk of Loss and Value Fluctuations. The amount of BTC on lightning delivered depends on the BTC/USD price, as determined by Tether Data. The value of Bitcoin is highly volatile. By participating, you acknowledge that the value of the Prize may increase or decrease following distribution.

1. First Come-First Served. Participants will be selected on a first come-first served basis from all eligible entries received during the Giveaway Period. The number of participants selected to received a Prize depend on the Giveaway Period and daily limit established by Tether Data.
2. Selected Participant Decisions. Decisions made by Tether Data as to the selection of potential recipients of a Prize and all matters related to the Giveaway shall be final and binding.
3. No Bots or Automation. The use of multiple Tether.me or X accounts, scripts, bots or similar entry mechanisms is strictly prohibited and will result in your attempted participation being ineligible. Tether data reserves the right to disqualify any participant suspected of inappropriate behaviour including "farming", spamming or otherwise using automated mechanisms.

All income and other taxes resulting from acceptance of a Prize, if any, are the responsibility of the participant. The Giveaway is subject to all applicable laws and regulations. Tether Data reserves the right without liability to disqualify any participant or cancel, suspend, modify and/or terminate the Giveaway, or any part of it, for any reason, including, but not limited to, abuse, technical errors, human or otherwise, suspected or actual evidence of electronic or non-electronic tampering with any portion of the Giveaway, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Giveaway or any other factor beyond Tether Data's reasonable control, as determined by Tether Data in its sole and absolute discretion.

In such event, Tether Data reserves the right to award the Prizes to the extent required by law for eligible entries submitted up to the time of the impairment (and/or thereafter), or in such other manner as deemed fair and appropriate by Tether Data in its sole and absolute discretion. Tether Data reserves the right to disqualify any participant it finds to be tampering or interfering with the operation of the Giveaway, acting in violation of the Rules or in an abusive or disruptive manner and void all such participant's entries.

ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, TETHER DATA RESERVES THE RIGHT TO SEEK CIVIL AND/OR CRIMINAL PROSECUTION AND DAMAGES (INCLUDING ATTORNEYS' FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. The invalidity or unenforceability of any provision of the Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Tether Data's failure to enforce any term of the Rules will not constitute a waiver of that provision. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.

By entering the Giveaway, participants waive all rights to claim punitive, incidental and consequential damages, attorneys' fees or any damages other than actual out-of-pocket costs incurred to enter. Participants hereby release Tether Data, its affiliates, officers, directors and contractors (the "Giveaway Parties") from any and all liability, of whatever nature, associated with the Giveaway, including, without limitation, as to Prize delivery and fulfilment. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Rules, or the rights and obligations of the participant and Tether Data in connection with the Giveaway shall be governed by, and construed in accordance with, the laws of the British Virgin Islands, without giving effect to any choice of law or conflict of law rules. The venue for any dispute shall be the courts of the British Virgin Islands.

By participating in the Giveaway, participant releases and holds the Giveaway Parties harmless from any and all liability for any injuries, loss or damage of any kind to the participant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in the Giveaway, any breach of the Rules, or in any Prize-related activity. The participant agrees to fully indemnify Giveaway Parties from any and all claims by third parties relating to the Giveaway, without limitation.

The Giveaway Parties assume no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions of the X platform that may affect the transmission or non-transmission of an entry. Tether Data is not responsible for any incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error which may occur in the administration of the Giveaway. Tether Data assumes no responsibility or liability in the event that the Giveaway cannot be conducted as planned for any reason, including those reasons beyond the control of Tether Data.

Tether Data is not responsible for damages caused by delay or failure to perform undertakings under the Rules when the delay or failure is due to health crises, fires; strikes; floods; power outages or failures; acts of God or the state's enemies; acts of any government or government official; any and all market movements, shifts, or volatility; computer, server, or Internet malfunctions; security breaches or cyberattacks; criminal acts; delays or defaults caused by common carriers; acts or omissions of other persons; or, any other delays, defaults, failures or interruptions that cannot reasonably be foreseen or provided against. In the event of force majeure, Tether Data is excused from any and all performance obligations under the Rules.

All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, illustrations, slogans and representations are owned by Tether Data and/or its affiliates. All rights are reserved.

Tether Data reserves the right, in its sole discretion, to terminate the Giveaway, in whole or in part, and/or modify, amend or suspend the Giveaway, and/or the Rules in any way, at any time, for any reason without prior notice.

In the event of any discrepancy or inconsistency between the terms and conditions of the Rules and disclosures or other statements contained in any Giveaway-related materials, including but not limited to the description on X, print or online advertising, the terms and conditions of the Rules shall prevail.

This Giveaway is in no way sponsored, endorsed or administered by X Group or any social media platforms on which the Giveaway may be promoted and/or publicized.
